How is a divorce processed in Costa Rica?

Divorce by mutual consent can be requested when both spouses decide to end their union; it can be requested at any time after the marriage has taken place.

To process a divorce by mutual consent, the spouses must submit the following information in a public document to the corresponding Family Court:

  1. Specify who will be responsible for the custody, upbringing, and education of minor children.
  2. Indicate which spouse will assume the financial support of the children or if both will share the responsibility.
  3. Total amount of alimony that one spouse agrees to pay to the other, if applicable.
  4. Agreed division of properties.

On the other hand, contested divorce is one where one party is not willing to divorce, requiring the intervention of a judge.
