Divorce by mutual consent can be requested when both spouses decide to end their union; it can be requested at any time after the marriage has taken place.
To process a divorce by mutual consent, the spouses must submit the following information in a public document to the corresponding Family Court:
- Specify who will be responsible for the custody, upbringing, and education of minor children.
- Indicate which spouse will assume the financial support of the children or if both will share the responsibility.
- Total amount of alimony that one spouse agrees to pay to the other, if applicable.
- Agreed division of properties.
On the other hand, contested divorce is one where one party is not willing to divorce, requiring the intervention of a judge.
